  FREQUENTLY ASKED QUESTION
Ques. Which are the institutions which do not have to pay Wakf Contribution?
Ans. Wakf Institutions who’s Net Annual Income is less than Rupees five thousand are exempted from payment of Wakf Contribution. If the Net Annual Income exceeds Rs. 5000/-in subsequent years, they are libel to pay the Wakf Contribution.
Ques. When to calculate the Wakf Contribution?
Ans. Wakf Contribution should be calculated at the end of each financial year i.e., 31st of March.
Ques. How to pay Wakf Contribution?
Ans. The Wakf contribution can be paid at the local district Wakf Advisory Committee office through D.D/ Cheque/Cash, by obtaining proper acknowledgment. The Form-50 and 88 should also be submitted.
Ques. What is the maximum period for which a Muthawalli //managing Committee can lease an immovable Wakf property belong to the Institution?
Ans. A Muthawalli /Managing Committee can lease a immovable Wakf property for a maximum period of one year only. (Normally they do it for 11months). Such properties can be leased for more than one year and not exceeding a maximum period of the Wakf Board as per Section 56(2) of the Wakf Act & Rule53 of the Karnataka Wakf Rules, 1997. Ques. What is the other important account that should be maintained?
Ans. As per Section 44 of the Act, Annual Budget must be prepared showing the estimated receipts and expenditure. It must be submitted to the local District Wakf Advisory Committee office by 1st December each year. In the budget, adequate financial provisions must be made for. A) Carrying out the objects of the Wakf. B) For maintenance and preservation of the Wakf property. C) For discharging of liability and commitment. As noted in the introduction, and as per the need of the Muslim Community, 10% and 05% of the Net Annual Income should be reserved for education and medical needs respectively and distributed to the deserving case. The amount could be spent for any other charitable purpose also. Amount could be spent as per Wakf deed of the Wakif i.e.; Mansha-e Wakif which gets priority.
Ques. What are the duties of Muthawalli?
Ans. As per the Section 50 of the Wakf Act, 1995 it shall be the duty of every Muthawalli:- (a) To carry out the directions of the Board in accordance with the provisions of this Act or of any rule or order made there under; (b) To furnish such returns and supply such information or particulars as may from time to time be required by the board in accordance with the provisions of this act or of any rule or order made there under; (c) To allow inspection of Wakf properties, account or records or deeds and documents relating thereto; (d) To discharge al public dues; and (e) To do any other act which he is lawfully required to do by or under this act.
